Privacy – New bill to reform the Data Protection Law

In August, the Agency for Access to Public Information announced that it will begin the process of reforming the Data Protection Law No 25.326 which was enacted in 2000. To that end, it was announced that they will offer the possibility of new spaces for debate with public organizations, civil society organizations, universities, and the private sector. Furthermore, the public consultation body will take place in September.
The announcement highlights the intention to create a new bill that reflects the new challenges imposed by technological transformations and the development of the digital economy, all of this in accordance with “the highest regional and international standards from a human rights perspective, situated and with a sovereign perspective”.
Moreover, the Agency established as precedents for this new reform of the law the bill of 2018 that had already lost parliamentary status, and they also included other foreign regulations such as the General Data Protection Regulation (GDPR) of the European Union, the Law N° 27.483 approving the Convention 108 of the Council of Europe for the protection of persons concerning the automated processing of personal data, the Data Protection General Law from Brazil, the Data Protection Organic Law from Ecuador and the Personal Data Protection Standards of the Ibero-American Data Protection Network (RIPD), among others.
