Important Update on Advertising Regulations: Argentina’s Resolution No. 12/2024

The Argentine Secretariat of Industry and Commerce has enacted Resolution No. 12/2024, a pivotal regulation that aims to enhance transparency and fairness in advertising practices. Effective from May 2024, this new mandate requires all advertisements to clearly and accessibly disclose essential information about products and services.

Resolution No. 12/2024 of the Secretariat of Industry and Commerce (“Resolution”), published in the Official Gazette on April 24, 2024, provides for certain rules related to the advertising of goods and services, as follows:

  • Information on the scope and validity of the offer as well as the name address and tax identification number of the relevant business must be provided in the advertisement using legible and clear characters.
  • The advertising must inform the essential features of the product, the conditions of sale and the remaining stock through a website or toll-free telephone line using the following language: “FOR MORE INFORMATION AND APPLICABLE CONDITIONS OR LIMITATIONS, SEE [WEBSITE]” and “FOR MORE INFORMATION AND APPLICABLE CONDITIONS OR LIMITATIONS, PLEASE CONTACT TOLL-FREE PHONE…”.
  • When disclosing prices of products or services, the following additional rules must be met:
    • Non-financed Price Advertising: Prices must be expressed in national currency, indicating that they correspond to cash payments.
    • Financed Price Advertising: Details such as down payment, number and amount of installments, annual effective interest rate, total financial cost, and any additional expenses or insurance must be included. This should be informed through a website or a toll-free telephone line as noted above.
  • Failure to comply with these provisions will entail the sanctions provided for by Fair Trade Decree No. 274/2019 and/or Consumer Protection Law No. 24,240 and supplementary regulations.
  • The Resolution abrogates previous Resolution No. 915/2017 of the former Secretariat of Commerce.
