New program for transparency and personal data protection in the use of Artificial Intelligence

On September 4th, 2023, Resolution No. 161/2023 (hereinafter “Resolution”) of the Argentine Agency for Access to Public Information (hereinafter, “AAPI”) was published in the Official Gazette, approving the Program for transparency and personal data protection in the use of Artificial Intelligence (hereinafter, the “Program”).

The main purpose of the Program is to promote processes of analysis, regulation and strengthening the institutional capacities needed to support the development and use of Artificial Intelligence (hereinafter, “AI”), both in the public and private sectors, ensuring the effective exercise of citizens’ rights to transparency and protection of personal data.

Specifically, the Resolution seeks to: 1) investigate the social, economic, labor, cultural and environmental implications of AI in Argentina; 2) analyze the use of AI in national public sector organizations; 3) generate knowledge to identify good practices, learning and recommendations in transparency, algorithmic transparency and protection of personal data in the use of AI; 4) strengthen the institutional capacities of key stakeholders involved in AI implementation in relation to transparency and protection of personal data; 5) promote participatory processes to develop AI regulatory proposals in Argentina, in collaboration with other relevant government agencies.

An action divided into three components were created to achieve the above-mentioned purposes.

  • Component 1. This consists in:
    • creating an observatory on AI for following up of governmental and non-governmental actors involved in this topic;
    • monitoring regional and global developments in the regulation of technological solutions based on AI and the creation of statistics and journalistic reports.
  • Component 2. This consists in:
    • organizing the governance and social participation of AI through a Multidisciplinary Advisory Council with experts in the field.
    • encouraging the interaction of the AAPI to develop regulatory strategies to address rights violations and prevent negative impacts of the use of AI, in coordination with other relevant government agencies.
  • Component 3. This consists in:
    • creating good practice guidelines for public and private entities;
    • providing training and technical assistance, awareness campaigns, media and information literature;
    • documenting records concerning Automated Decision-Making Systems (ADS), among others.
