The Argentine Data Protection Authority publishes the Guidelineslines for the Responsible Use of Artificial Intelligence

The Agency for Access to Public Information (“AAPI”), controlling authority of the Personal Data Protection Law, has developed and published the “Guidelineslines for Public and Private Entities on Transparency and Personal Data Protection for Responsible Artificial Intelligence” (“Guidelineslines”).

The Guidelines aims to ensure the responsible use of Artificial Intelligence (“AI”) and targets both public and private entities.

This initiative is part of the Transparency and Personal Data Protection Program in the Use of AI, launched by the AAPI in 2023 through Resolution No. 161/2023. The main goal of the Program is to promote processes of analysis, regulation, and capacity-building within the public sector to support the development and use of AI in both public and private sectors, ensuring that citizens’ rights to transparency and personal data protection are upheld. One of the key components of the AAPI’s Program involves developing capacities among public and private sector actors to understand the challenges posed by incorporating AI into automated decision-making systems and to provide tools to address these challenges in accordance with ethical principles outlined by international instruments.

The Guidelines outlines its objectives and discusses the main issues and challenges surrounding AI. The Guidelines also outlines recommendations applicable to the various stages of the AI system lifecycle, including:

  • System Design: This phase involves planning and designing the system, with a focus on selecting and processing input data, developing the algorithmic model, and training the model.
  • Verification and Validation: Once the system is defined, testing is conducted to ensure proper operation.
  • Implementation: This phase involves putting the system into operation, which requires prior setup of the necessary infrastructure.
  • Operation and Monitoring: At this stage, the system is fully operational, available for use, and its performance is continuously monitored.
